Registrants and Downstream Users’ comments on Substance Evaluation (draft) decisions and notification of submitted data (final decision based requests)

The web-form shall serve as a secure way for a Registrant to submit comments to a specific ECHA draft decision prepared by a Member State as a result of the substance evaluation (Article 50(1) REACH Regulation). Further in the decision making process for substance evaluation, competent authorities of the Member States and ECHA may submit proposal(s) for amendment to the draft decision (Article 51(2) REACH Regulation). The Registrant can submit comments on any of the received proposal(s) for amendment (Article 51(5) REACH Regulation) via this web-form.

This web-form should only be used by a Registrant after having received a specific invitation(s) from ECHA Secretariat through REACH-IT to comment. Under substance evaluation process ECHA advises Registrants to coordinate their comments and submit only one set of comments, if possible, for a specific draft decision. All details which a Registrant will require to access and complete this web-form will be included in the specific invitation. A specific deadline for submission of the comments will be clearly indicated. Registrants are encouraged to submit comments only once within the specific deadline via this web-form. As each web-form is for a specific ECHA decision, Registrants should not re-access this web-form to comment on other ECHA decisions.

Additionally this web-form serves the Registrant in the follow-up phase to notify ECHA of the dossier update which contains all data requested by the final decision. Please note that the Registrant will not receive a specific invitation for this activity. It is the Registrant’s responsibility to submit the data at the latest by the deadline(s) indicated in the decision.

Thus this webform can be used to comment/inform for the following purposes:

- on a Member State competent authority draft decision (Article 50(1) REACH Regulation),
- on any proposal for amendment (Article 52 and 51(5) REACH Regulation),
- to agree on the publication of the non-confidential version of the finalised decision,
- to dedicate a party for performing test(s) on behalf of others (Article53(1)),and
- to indicate the availability of all requested data of a decision in form of a dossier update

ECHA invites registrants and downstream users, to reach an agreement on who will perform and submit a requested test(s) on behalf of the others, in accordance with Article 53 of the REACH Regulation. If ECHA is not informed of such agreement within 90 days of taking the decision, it will designate one of the registrants or downstream users to perform the test(s) on behalf of all of them. Every effort shall be made to reach an agreement as to who is to carry out the test(s).
